1. Acceptance of Terms
These Terms of Service ("Terms") are an agreement between you and SPACEV Technologies ("SPACEV," "we," "us," or "our"). By accessing or using Atlas, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Atlas.
If you use Atlas through a university, estate, employer, or other organization, additional organization policies may apply. You represent that you are authorized to use the account and organization workspace provided to you.
2. Description of Atlas
Atlas is designed to help users request and coordinate emergency or safety assistance. Depending on the participating organization, Atlas may support alerts, location sharing, emergency contacts, notifications, response coordination, maps, medical context, and incident records.
Features, responders, participating departments, and response processes can differ between organizations and may change over time.
3. Emergency Service Disclaimer
Atlas is not a guaranteed substitute for police, ambulance, fire, or other official emergency services.
If you face an immediate emergency, contact the appropriate official emergency service or another available source of help whenever it is safe and possible to do so.
Atlas functionality may be affected by internet or mobile connectivity, device permissions, battery level, location accuracy, notification delivery, responder availability, organization staffing, user-provided information, and third-party services. Sending an alert does not guarantee that it was received, accepted, or acted on within any particular time.
SPACEV does not claim a partnership with any governmental or official Nigerian emergency service unless that relationship is expressly stated in writing for a specific deployment.
4. User Responsibilities
You agree to:
- Provide accurate account and incident information where reasonably possible.
- Use emergency features only for genuine safety or operational needs.
- Keep your contact, organization, and relevant medical information current.
- Follow lawful instructions from authorized responders and organization personnel.
- Use reasonable judgment and seek alternative help when Atlas is unavailable.
5. Account Security
You are responsible for safeguarding your login credentials and device. Do not share credentials or allow unauthorized access to your account. Notify SPACEV or your organization promptly if you believe your account has been compromised.
6. Acceptable Use
You must not:
- Submit knowingly false, malicious, or abusive emergency alerts.
- Harass, impersonate, threaten, or endanger another person.
- Attempt to access information or functions beyond your authorized role.
- Interfere with Atlas, its infrastructure, or another user's access.
- Reverse engineer, exploit, or misuse Atlas except where applicable law permits.
- Use Atlas for unlawful activity or in violation of organization policy.
7. Availability of the Service
We aim to operate Atlas reliably, but the service may be interrupted, delayed, changed, or unavailable. We may perform maintenance, address security concerns, modify features, or discontinue parts of the service. Organizations are responsible for maintaining appropriate alternative emergency procedures.
8. Third-Party Services
Atlas may rely on third-party infrastructure, mapping, messaging, notification, device, or connectivity services. Those services may be governed by separate terms and policies. SPACEV is not responsible for third-party systems outside its reasonable control.
9. Intellectual Property
Atlas, including its software, branding, interfaces, text, and related materials, is owned by SPACEV or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, SPACEV grants you a limited, personal, revocable, non-exclusive, non-transferable right to use Atlas for its intended purpose.
10. Disclaimers
To the extent permitted by applicable law, Atlas is provided "as is" and "as available." SPACEV does not warrant uninterrupted operation, exact location accuracy, notification delivery, responder availability, or a particular emergency outcome. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of Liability
To the extent permitted by applicable law, SPACEV will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of or inability to use Atlas, including delays caused by connectivity, third-party services, inaccurate information, or responder availability. Any limitation applies only to the extent legally allowed and does not exclude liability that cannot be excluded by law.
12. Suspension and Termination
We or a participating organization may restrict, suspend, or terminate access where reasonably necessary to address misuse, security risk, policy violations, legal requirements, or the end of an organization relationship. You may stop using Atlas at any time and may request account deletion as described in the Privacy Policy.
13. Changes to the Terms
We may update these Terms as Atlas or applicable requirements change. We will publish updated Terms here and revise the date above. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
14. Governing Terms
These Terms are governed by the applicable laws of the Federal Republic of Nigeria, without limiting any mandatory rights you may have under other applicable law. The parties should first attempt to resolve a dispute in good faith before pursuing available formal remedies.
